A) Terms and conditions of sale


These Terms and Conditions of Sale (“T&Cs”) govern the purchase of ISO Publications and are entered into between the International Organization for Standardization, ISO Central Secretariat, Chemin de Blandonnet 8, CP 401, 1214 Vernier, Geneva, Switzerland (“ISO”), and the purchaser or end-user of the ISO Publication (the “Licensee”). 

By placing an order for an ISO Publication, or by accessing, downloading, installing, or otherwise using the ISO Publication, the Licensee accepts and agrees to be bound by these T&Cs and by the End Customer Licence Agreement. The Licensee shall ensure that it has read and understood all applicable terms before completing the purchase.

1. Invoice and payment 

The Licensee shall pay the applicable price as invoiced by ISO. After placing an order, an invoice will be automatically e-mailed to the purchaser in PDF format.  

All payments must reference the relevant order number. The Licensee is responsible for all bank charges, transfer fees, and foreign exchange risks associated with the payment. The Licensee is also responsible for any local taxes, customs duties, or other charges imposed by the destination jurisdiction. 

Local taxes are applied to orders with a billing address in Switzerland. No taxes are charged for delivery of products outside of Switzerland.  

Orders can be paid by credit card or bank transfer. MasterCard, Visa, and American Express are accepted. Payments by bank transfer must be made in Swiss Francs (CHF) and include the relevant order number. All bank charges for remittances are borne by the Licensee, whose payment information will be processed immediately and confidentially. 

Please make sure that during the shopping process the Licensee’s full billing information is indicated. The invoice will also be available for download from the Licensee’s account. 


2. Security 

The connection to the ISO webstore is protected using TLS 1.3, the latest industry-standard security protocol. Credit card details and personal information are transmitted through secure encrypted connections using a minimum of 128-bit encryption, helping preserve data integrity and confidentiality. 


3. Delivery and Provision of ISO Publications 

Hard-copy ISO Publications are dispatched once the order has been processed. Delivery may be carried out via standard or express postal services, depending on the destination and service availability. 

All orders for documents in paper format or CD-ROM, or other similar media are shipped from the ISO Central Secretariat in Switzerland and are dispatched as soon as the order has been processed (either the same day or the next business day). Shipments are made either by standard delivery (Swiss Post, estimated delivery time of 4–15 business days, without tracking) or by express delivery (DHL, estimated delivery time of 2–4 business days, with tracking). For shipments to Mexico, only express delivery is available, while for shipments within Switzerland, only standard delivery is available. 


4. Returns Policy and Termination  

Returns are not accepted for electronic documents. 

Returns of documents supplied in hard-copy format, CD-ROM, or other similar media may be accepted only in cases of duplicate orders or, on an exceptional basis, on a case-by-case assessment. In all instances, returns are subject to ISO’s prior agreement and must follow the procedure specified by ISO. 

For termination of the use rights, please refer to the End Customer Licence Agreement. 


5. Data protection 

See the Privacy Policy, which is incorporated into these Terms. 


7. Relationship with End Customer Licence Agreement 

The ISO Publication may be provided to the Licensee in different formats, including in hard-copy form or by electronic means, such as downloadable files or access via an online tool or software-as-a-service (SaaS) platform. For both, hard-copy as well as electronic versions, license rights apply to the content of the ISO Publications. Content of ISO Publications is made available under licence, as further specified in the End Customer Licence Agreement, and not sold.  

ISO Publications are protected by copyright law and other applicable laws. Use of ISO Publications, including permitted use, restrictions, intellectual property rights, compliance obligations, and termination, is governed exclusively by the End Customer Licence Agreement. Certain uses, including digital, automated, or AI-related uses, are restricted and may require additional licences, as set out in the End Customer Licence Agreement. 

In the event of any inconsistency, the End Customer Licence Agreement shall prevail with respect to the use of ISO Publications. 


8. Limitations 

To the maximum extent permitted by law, the ISO Publications are sold and licensed without any representation, warranty and/or liability, except in cases of damage caused by gross negligence or intent. 


9. Governing Law and Dispute Resolution 

These T&Cs are governed exclusively by the laws of Switzerland, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 and any rules on conflict of laws. 

Disputes arising under, or in connection with, these T&Cs shall be exclusively subject to the jurisdiction of the competent court of the city of Geneva, Switzerland. 


 

B) End Customer Licence Agreement


This End Customer Licence Agreement (“Licence Agreement”) is entered into between the International Organization for Standardization, ISO Central Secretariat, Chemin de Blandonnet 8, CP 401, 1214 Vernier, Geneva, Switzerland (“ISO”), and the purchaser or end-user of the ISO Publication (the “Licensee”). 

ISO publishes standards and other content (each an “ISO Publication”). By placing an order for an ISO Publication, or by accessing, downloading, installing, or otherwise using the ISO Publication, the Licensee accepts and agrees to be bound by the terms of this Licence Agreement and the Terms and Conditions of Sale. The Licensee shall ensure that it has read and understood all applicable terms before completing the purchase.

1. Scope  

This Licence Agreement sets out the terms under which ISO grants the Licensee access to, and rights to use, the ISO Publication, whether in whole or in part. Any reference to the “ISO Publication” in this Licence Agreement shall be interpreted as including the publication in its entirety or any part thereof, as applicable.  

Depending on the ISO’s confirmation notice to Licensee and the applicable licence fee, the ISO Publication is licensed for the Licence Type selected at the time of purchase and confirmed by ISO, as further defined in Section 4. 

The licence granted under this Licence Agreement applies only to the specific edition of the ISO Publication purchased or downloaded by the Licensee. It does not include any previous or subsequent editions. Unless expressly agreed otherwise, ISO does not provide document updates, maintenance services, or support services for the ISO Publication. 


2. Provision  

The ISO Publication may be provided to the Licensee in different formats, including in hard-copy form or by electronic means, such as downloadable files or access via an online tool or software-as-a-service (SaaS) platform. For both, hard-copy as well as electronic versions, license rights apply to the content of the ISO Publications. Content of ISO Publications is made available under licence, as further specified in this End Customer Licence Agreement, and not sold. 

Where the ISO Publication is provided electronically, the Licensee may download and store a copy on all the Licensee’s personal devices (such as desktop computers, laptops, tablets, e-readers, or smartphones). For identification and rights-management purposes, electronic copies of the ISO Publication are watermarked in accordance with the selected Licence Type and with the account information provided by the Licensee at the time of purchase, including the Licensee’s email address. Access or storage of the ISO Publication on shared systems, networks, or platforms is permitted only to the extent authorized under the applicable Licence Type.  

Where the ISO Publication is provided in hard-copy form, photocopying or reproduction in any form is not permitted without prior written authorization from ISO. 

Licensee further acknowledges and agrees that ISO may, in its sole discretion, discontinue the creation, development, and/or provision of ISO Publications, and/or may withdraw ISO Publications altogether. 


3. ISO’s Intellectual Property Rights  

The ISO Publication is protected by copyright law, database law, trademark law, unfair competition law, trade secret law, and any other applicable laws. The Licensee acknowledges and agrees to respect ISO’s intellectual property rights in the ISO Publication and shall refrain from any act that may infringe, misappropriate, or otherwise violate such rights. 

The ISO Publication, together with any updates, corrections, derivative works, or ancillary materials, and all intellectual property and other proprietary rights therein, are owned by ISO.  

Where an ISO Publication is supplied in physical form, ownership of that medium may transfer to the purchaser; however, all intellectual property rights in the content of the ISO Publication remain with ISO. Any use of content is subject to the terms of this Licence Agreement and, where applicable, to additional licences that may be required, as described in this Licence Agreement (e.g., Sections 6 and 7).  

Nothing in this Licence Agreement shall be construed as assigning, transferring or otherwise granting to the Licensee any intellectual property rights in the ISO Publication, except for the limited rights expressly set out herein. 

If ISO or its licensors are no longer authorized to license an ISO Publication, or if an infringement claim arises, ISO may withdraw access temporarily or permanently, and the Licensee shall suspend or cease all use of such ISO Publication.  


4. License Grant 

Subject to full payment of the applicable fee and the Licensee’s compliance with this Licence Agreement (including, but not limited to, Sections 6 and 7), ISO grants the Licensee a non-exclusive, non-transferable, limited and revocable licence to use the ISO Publication in accordance with the Licence Type selected at the time of purchase, as specified in ISO’s confirmation notice to Licensee.  

The Licensee shall use the ISO Publication solely within the scope of the applicable Licence Type, subject to any associated access limitations. Different Licence Types may be subject to different terms and applicable fees. 

Permitted use includes the right to access, read, consult, and internally reference the ISO Publication, as well as to understand, evaluate, and apply its content within the Licensee’s internal operations, internal processes, internal management systems, internal products, and internal services.  

Except where expressly authorized under additional licences, as set out in Sections 6 and 7, this Licence does not include rights of reproduction, distribution, adaptation, incorporation, digital integration, or creation of derivative works of the ISO Publication, in whole or in part. 

Licence Type 

The Licence Type determines the authorized extent of access within the Licensee’s organization, as specified in the confirmation notice. The following categories may apply: 

i. Single Registered End-User Licence
Permits access to the ISO Publication by the Licensee as a single named end-user, either as an individual or within one legal entity.  

The ISO Publication may not be shared with any other person or stored on shared systems or networks even within the Licensee’s legal entity. 

ii. Single Network Licence
Permits access to the ISO Publication by the agreed number of named and/or unnamed concurrent end-users within the Licensee’s legal entity, through the Licensee’s internal network or access system, within one physical site. 

iii. Enterprise Network Licence
Permits access to the ISO Publication by the agreed number of named and/or unnamed concurrent end-users through the network within multiple physical sites of the Licensee’s legal entity or across the Licensee’s entire group entity. 

Any other use, or any access by users, on networks or at sites not expressly authorized, requires a separate licence from ISO, an ISO Member Body, or an authorized distributor. 


5. Codes and Graphical Symbols (and their Collections) 

Subject to the selected Licence Type, the Licensee may use codes (such as language, currency, and country codes) and graphical symbols for the implementation of their respective ISO Publication. This includes using a graphical symbol in accordance with its recognized meaning, for example using the “No smoking” symbol to designate a non-smoking area. 

The Licensee may not post, publish, resell, distribute, or otherwise make codes, graphical symbols, or collections thereof available on the Internet or through any publicly available platform. Any use of codes or graphical symbols beyond what is permitted under the selected Licence Type requires a separate licence from ISO, an ISO Member Body, or an authorized distributor. 


6. Acts requiring additional licence rights 

Any of the following acts require an additional licence from ISO, an ISO Member Body, or an authorized distributor: 

a) Reproduction or incorporation of ISO Publications in Non-Digital Materials 

Any reproduction, copying, distribution, adaptation, or incorporation of the ISO Publication, in whole or in part, into any printed or non-digital material, including but not limited to: 

  • internal or external reports; 
  • manuals, procedures, training materials, or guidance documents; 
  • presentations or communication materials; 
  • publications, products, or services made available to third parties; 
  • any other printed or non-digital document or material. 

b) Digital integration or incorporation of ISO Publications 

Any integration, embedding, encoding, structuring, transformation, or operationalization of the ISO Publication within any digital or software-based environment, including but not limited to: 

  • software applications or workflow tools; 
  • rules engines, compliance systems, or automated decision-making tools; 
  • databases, data models, or structured datasets; 
  • automated or AI-enabled tools; 
  • digital platforms or services; 
  • any similar digital solution used internally or made available to third parties. 

7. Use Restrictions 

Except as expressly permitted under this Licence Agreement or the confirmation notice, the Licensee is not authorized to undertake any of the following acts. 

a) General prohibitions 

The Licensee shall not: 

  • use the ISO Publication outside the scope of the Licence Type granted under this Licence Agreement and specified in the confirmation notice; 
  • grant use or access rights to the ISO Publication beyond what is permitted under the Licence Type;  
  • disclose the ISO Publication to any third party beyond what is permitted under the Licence Type;  
  • sell, lend, lease, reproduce, distribute, import/export or otherwise commercially exploit the ISO Publication, in whole or in part;  
  • assign or otherwise transfer ownership of the ISO Publication to any third party.  

b) Artificial Intelligence and Machine Learning Uses 

The Licensee is not permitted to access, use, or process the ISO Publication for or related to any machine learning, artificial intelligence (AI), or analogous computational purposes, unless such use is expressly authorized under a separate licence agreement issued by ISO, an ISO Member Body, or an authorized distributor. 

This restriction includes, without limitation, any unlicensed use of the ISO Publication for: 

  • training, fine-tuning, or evaluating language models (LM), machine-learning systems, generative AI models, or similar models or systems; 
  • embedding, prompting, querying, comparing, or otherwise enabling an AI or ML models or system to ingest, reproduce, restate, summarize, translate, reformulate, or generate outputs derived from the ISO Publication; 
  • structured extraction, text and data mining, harvesting, or processing of the text, structure, logic, metadata, or other elements of the ISO Publication for model training, dataset creation, benchmarking, or automated knowledge extraction; 
  • any other activity intended to enable an AI or ML system to ingest, analyze, internalize, or generate content based on the ISO Publication. 

ISO expressly opts out of the text-and-data-mining exception under Article 4 of Directive (EU) 2019/790. The Licensee may not rely on any statutory text-and-data-mining exceptions to justify AI- or ML-related use of the ISO Publication. 


8. Compliance  

The Licensee shall maintain accurate, complete, and up-to-date records of all matters relevant to its use case and Licence Type as well as its compliance with this Licence Agreement. The Licensee shall promptly notify ISO in writing of any change to the Licence Type at: copyright@iso.org

If ISO has reasonable grounds to believe that the Licensee is not complying with the terms of this Licence Agreement, ISO may, upon written notice, conduct an audit or require that an audit be carried out by an independent third-party auditor. Such audit may be performed during normal business hours at the Licensee’s premises or through remote access, as appropriate. 

Any underpayment of licence fees identified through an audit shall be invoiced to the Licensee and paid in full. If the audit reveals an underpayment, the Licensee shall also bear all costs of the audit and shall reimburse ISO for such costs within thirty (30) days of receiving written notice specifying the amount due. 


9. Non-Disclosure 

Except as expressly permitted under the selected Licence Type, the Licensee shall not, and shall ensure that its authorized users do not, disclose the ISO Publication to any third party, regardless of whether the ISO Publication is marked as not to be disclosed. 

Where the Licensee obtains access to the ISO Publication through an online platform, login credentials, passwords, or access tokens provided by ISO shall be kept confidential and shall not be shared with any third party or with any unauthorized user within the Licensee’s legal entity. 

The Licensee’s non-disclosure obligations shall survive the expiration or termination of this Licence Agreement. The return or destruction of copies of the ISO Publication shall not relieve the Licensee of its continuing obligation to prevent any unauthorized disclosure. 

In the event of a breach of these non-disclosure obligations, ISO shall be entitled to apply a fee uplift equivalent to three times the applicable licence fee per breach, without prejudice to ISO’s right to claim additional damages or pursue any other remedy available at law or in equity. Payment of the fee uplift shall not release the Licensee from its confidentiality obligations. 


10. Term and Termination 

The Single Registered End-User Licence is granted only for the edition of the ISO Publication affirmed in ISO’s confirmation notice to Licensee. Subject to withdrawal by ISO of rights granted hereunder due to Licensee’s breach of the terms of this End User License Agreement, the rights are limited to the acquired edition. It does not grant the Single Registered End-User any rights to revisions and/or new editions of such ISO Publication. 

The Single Network Licence and the Enterprise Network Licence for ISO Publications are granted under a subscription model. The licence shall automatically expire at the end of the applicable subscription period. License to future revisions and/or editions of the acquired ISO Publication requires continued subscription. Licensee shall be entitled to revisions and/or new editions of the acquired ISO Publication if they are released during Licensee’s subscription period. 

Without prejudice to any other rights or remedies, ISO may terminate this Licence Agreement at any time upon written notice if the Licensee fails to comply with its terms. 

Upon expiration (e.g., subscription model) or termination of this Licence Agreement, the Licensee shall irretrievably delete all electronic copies and/or destroy all physical copies of the ISO Publication in its possession or control. The Licensee’s obligations that are stated to survive termination shall continue in full force and effect. 


11. Limitations 

The ISO Publication is provided “as is” and without any representations or warranties of any kind, whether express or implied. Without limiting the foregoing, ISO makes no warranty as to the accuracy, completeness, correctness, merchantability, fitness for a particular purpose, or non-infringement of the ISO Publication. 

To the maximum extent permitted by law, ISO and its auxiliary persons shall not be liable for any damages arising under or in connection with this Licence Agreement, except in cases of damage caused by gross negligence or intent. 

The Licensee acknowledges that the ISO Publication may be derived from multiple sources and shall comply with all applicable laws in connection with its use. The Licensee uses the ISO Publication at its own risk and is solely responsible for its access to and use of the ISO Publication. 

The Licensee shall indemnify, defend, and hold harmless ISO and its auxiliary persons from and against any and all costs, expenses, damages, losses, or liabilities arising out of, or in connection with, the Licensee’s use of or access to the ISO Publication, or any breach of this Licence Agreement. 


12. Data Protection  

ISO processes personal data as a data controller in accordance with applicable data protection law and ISO’s Privacy Policy. Personal data provided by the Licensee during the purchase or use of the ISO Publication may be processed for purposes related to the administration, fulfilment, and enforcement of this Licence Agreement, as well as for any other purposes described in ISO’s Privacy Policy. 


13. Governing Law and Dispute Resolution 

This Licence Agreement shall be governed exclusively by the laws of Switzerland, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 and any rules on conflict of laws. 

Disputes arising under, or in connection with, this Licence Agreement shall be exclusively subject to the jurisdiction of the competent court of the city of Geneva, Switzerland. 


14. Customer General Terms  

Any terms and conditions proposed by the Licensee, whether referenced in an order or contained in any other document, are expressly excluded and shall have no effect. 

The Licensee shall comply with all applicable export and import laws and regulations, including those of Switzerland, that prohibit or restrict the export of goods, services, or technologies to certain countries, end users, or end uses. 

The Licensee may not assign or transfer this Licence Agreement, or any rights or obligations under it, without ISO’s prior written approval. 

Nothing in this Licence Agreement grants the Licensee any rights to use ISO’s trademarks, logos, or other brand identifiers (“ISO Marks”). Any use of ISO Marks requires a separate written authorization by ISO. Any unauthorized use of ISO Marks constitutes a breach of this Licence Agreement and may result in termination, without prejudice to ISO’s other rights or remedies. 

If any provision of this Licence Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, provided that the essential purpose of this Licence Agreement is preserved. ISO undertakes to replace any invalid,  illegal, or unenforceable provision with a valid, legal, and enforceable provision that most closely reflects the original intent. The same principle applies to any omissions or open terms. 

ISO may modify the terms of this Licence Agreement from time to time. Any such modifications will be communicated to the Licensee at the email address provided during the order process. The Licensee shall have thirty (30) days from the date of such notification to reject the modified terms by notifying ISO at copyright@iso.org, in which case the Licence Agreement shall terminate. Continued access to or use of the ISO Publication after the expiry of the thirty-day period constitutes acceptance of the modified terms.
